OUR DATA PROTECTION STATEMENT

Thank you for your interest in our company. The protection of your personal data is very important to us. Your trust is of the utmost importance to us.

The processing of personal data, such as the name, address, email address, or telephone number of a specific person, will be carried out in accordance with the requirements of the General Data Protection Regulation and subject to the country-specific data protection requirements applicable to SWAROVSKI OPTIK. Our company wishes to inform you of the nature, extent, and purpose of the personal data we process by means of this data protection declaration. Furthermore, this data protection declaration also advises any data subject of the rights to which they are entitled. If it is necessary to process personal data and if there is no legal basis for such processing, we will generally seek the consent of the person concerned.

1. NAME AND ADDRESS OF DATA CONTROLLER

2. DEFINITIONS

The SWAROVSKI OPTIK data protection statement is based on the definitions used by the European policy and regulatory bodies for the adoption of the General Data Protection Regulation. Our data protection statement should be easily readable and understandable for the general public as well as our customers and business partners. To ensure this, we would first like to explain the terms we use.

In this data protection statement and on our website, we use the following terms:

2.1 Personal data

Personal data includes all information relating to an identified or identifiable natural person (hereinafter referred to as the “data subject”). A natural person is regarded as identifiable if they can be identified, either directly or indirectly, especially through allocation of an identifier such as a name, identification number, location data, an online ID, or one or more specific characteristics which express the physical, physiological, genetic, psychological, economic, cultural, or social identity of the natural person in question.

2.2 Data subject

The data subject is any identified or identifiable natural person whose personal data will be processed by the data controller.

2.3 Processing

Processing is any process carried out with or without the aid of automation or any such procedure relating to personal data, such as the capture, collection, organization, classification, storage, adaptation or alteration, reading, querying, use, disclosure by transmission, dissemination or any other form of provision, matching or linking, restriction, erasure, or destruction of data.

2.4 Limitation of processing

The limitation of processing is the marking of stored personal data with the intention of limiting its processing in future.

2.5 Profiling

Profiling is any kind of automated processing of personal data, which includes the use of personal data to analyze specific personal aspects relating to a natural person, and in particular to analyze or predict aspects regarding work performance, economic situation, health, personal preferences, interests, reliability, conduct, place of residence, or relocation of this natural person.

2.6 Pseudonymization

Pseudonymization is the processing of personal data in such a way that the personal data can no longer be associated with a specific person without the inclusion of additional information, provided that such additional information is stored separately and is subject to technical and organizational measures that ensure that the personal data cannot be associated with an identified or identifiable natural person.

2.7 Data controller or party responsible for data processing

The data controller or the party responsible for data processing is the natural or legal person, authority, agency, or other body that decides on the purpose and means of processing personal data, either alone or in conjunction with others. If the purpose and means of processing are specified by EU law or the law of the member states, the data controller and certain criteria may be specified under EU law or the law of the member states.

2.8 Data processor

The data processor is a natural or legal person, authority, agency, or other body that processes personal data on behalf of the data controller.

2.9 Recipient

The recipient is a natural or legal person, authority, agency, or other body to whom personal data is disclosed, irrespective of whether the data concerns a third party or not. Authorities that may receive personal data within the framework of a specific investigation order under EU law or the law of the member states are not, however, considered as recipients.

2.10 Third party

A third party is a natural or legal person, authority, agency, or other body other than the data subject, data controller, data processor, and those persons who are authorized to process the personal data under the direct responsibility of the data controller or the data processor.

2.11 Consent

Consent is any expression provided in an informed and unequivocal manner by the data subject, in the form of a declaration or any other unique affirmative action whereby the data subject makes it clear that they are in agreement with the processing of the personal data that concerns them.

3. PROCESSING ACTIVITIES IN DETAIL

We will explain the processing activities on our website below. Detailed information on the data processed, any recipients, the legal basis, and purposes of processing can be found in the relevant sections.

3.1 Capture of general data and information when using our website

The SWAROVSKI OPTIK website captures a range of general data and information every time the website is downloaded by a relevant person or an automated system. This general data and information is stored in the server’s log files. We may capture:

  • the browser types and versions used,

  • the operating system used to access the site,

  • the website from which our website is accessed (known as the referrer URL),

  • the sub-websites accessed by an accessing system via our website, (5)

  • the date and time of access to the website,

  • an internet protocol address (IP address),

  • the internet service provider of the accessing system, and

  • any other similar data and information that serves to reduce risk in the event of an attack on our IT systems.

This information is needed to (1) correctly deliver our website content, (2) optimize our website content and advertising, (3) ensure the long-term functionality of our IT systems and the technology behind our website, and (4) provide the law enforcement agencies with the necessary information in the event of a cyber-attack. This information is therefore used by SWAROVSKI OPTIK for statistical purposes and furthermore analyzed for the purpose of increasing data protection and data security within our company to ensure an optimum level of protection for the personal data we process. The server log file data is stored separately from all personal data actively provided by a relevant person (see below).

The legal basis for this data processing is Art. 6 section 1 subsection 1 point b GDPR, because we require the automatically captured data for effective provision of our website that you have requested (c.f. also our terms of use), and Art. 6 section 1 subsection 1 point f GDPR, because storage serves our legitimate interest to provide the website, displayed correctly on your device, and to ensure its stability and security. A secure and reliable visit to our website is in your interest, insofar as your confidentiality interests do not exceed our interests in this respect.

Further information on the collection of personal data within the framework of a visit to our website can also be found in the section entitled “Cookies” (see point 4 below).

You may withdraw your consent to data processing on the basis of legitimate interest at any time (see section 7), although you would then be unable to use our website since this processing is essential for technical reasons in order to display the site to you.

3.2 Contact

If you contact us, e.g. by email, telephone or post, we will store and process the personal data you send us. This could be

  • your name,

  • your enquiry,

  • your email address,

  • your telephone number,

  • your address,

  • other information you have voluntarily provided.

This data will be used exclusively for responding to your request or for making contact and will not be divulged to any third party without your consent.

The legal basis for this data processing is either Art. 6 section 1 subsection 1 point b GDPR, if you are party to a contract with us and your enquiry relates to the fulfilment of that contract, or your enquiry is to initiate pre-contract measures. Furthermore, we can base this processing on Art. 6 section 1 subsection 1 point f GDPR because the processing of this enquiry is in our mutual interest. We have a legitimate interest in checking the information you have provided and your enquiry and responding accordingly, and your voluntary use of the function does not outweigh your interest in the confidentiality of your personal data. You may withdraw your consent to data processing on the basis of legitimate interest at any time (see section 7).

3.3 Chat function

You can also contact our customer services team at the advertised times using the chat function on our website. In this case, we collect the following information:

  • your email address,

  • your enquiry,

  • other information you have voluntarily provided.

We process this to technically enable the chat and to respond to your enquiry.

We process this information either on the basis of Art. 6 section 1 subsection 1 point b GDPR if you a party to a contract with us and your enquiry relates to the fulfilment of that contract, or your enquiry is to initiate pre-contract measures. Furthermore, we can base this processing on Art. 6 section 1 subsection 1 point f GDPR because the processing of this enquiry is in our mutual interest. We have a legitimate interest in providing the chat function to quickly resolve your issue and your voluntary use of the function does not outweigh your interest in the confidentiality of your personal data. You may withdraw your consent to data processing on the basis of legitimate interest at any time (see section 7).

In order to offer the chat function, we use the service provider Intercom, Inc., 55 2nd Street, San Francisco, CA 94105, United States of America. We have concluded a data processing agreement with Intercom.

3.4 MY SERVICE and user account

https://myservice.swarovskioptik.com/ is our portal for any services. For example, you can use it to:

  • receive information or help on products, guarantee or warranty claims

  • register your products

  • order spare parts,

  • register devices for repair.

For many of the MY SERVICE functions, it is necessary for you to register and log into the SWAROVSKI OPTIK website, providing your personal data.

The legal basis for this data processing is Art. 6, section. 1 subsection 1 point b GDPR, because it serves to initiate and fulfil our contract with you.

Within the framework of this registration, we process the following mandatory information provided by you:

  • name and email address, and

  • language and country.

We furthermore store any additional information provided by you in your profile settings that may be necessary in relation to a service request (e.g. address, telephone number, product name, serial number, date and place of purchase). We process this data on the basis of Art. 6 section 1 subsection 1 point b GDPR, as this is necessary for the investigation and processing of your request and thus the initiation or fulfilment of a contract between us. We also process the serial number in our legitimate interest under Art. 6 section 1 subsection 1 point f GDPR, to determine the time of manufacture and to enable us to evaluate any quality defects or to identify counterfeit or stolen products. You may withdraw your consent to data processing on the basis of legitimate interest at any time (see section 7).

If you voluntarily provide further information (e.g. Company name, job title, free text), our processing of this information is based on your consent, Art. 6 section 1 subsection 1 point a GDPR.

You can manage and change any of this information in the secure customer area.

When you register on our website, we will also store

  • the IP address provided by your internet service provider (ISP),

  • the date, and

  • time of registration.

. The aforementioned data is stored because this is the only way that abuse of our services can be prevented and, if required, this data can be used to shed light on offences committed and breaches of copyright. In this respect, the storage of this data is permitted for the protection of SWAROVSKI OPTIK. In this respect, the processing is based on our legitimate interest, Art. 6 section 1 point f GDPR. This data may not, in principle, be disclosed to third parties, provided that there is no legal obligation to disclosure or that disclosure is not required for the purpose of criminal or legal proceedings.

3.5 Web shop

(a) Purchase

When you use our web shop to purchase products from our range, we will capture the following information:

  • First name and surname,

  • (optional) Title,

  • (optional) Address addition,

  • Address,

  • Telephone number, and

  • Email.

The legal basis for this data processing is Art. 6 section 1 clause 1 point b GDPR, because we need this information in order to process your order.

(b) Payment

(c) Shipping

To ship your order, it is necessary to pass on your personal information to a shipping service provider. The legal basis for this data processing is Art. 6 section 1 clause 1 point b GDPR, because this is necessary in order to process your order.

(d) Shopping cart abandonment

If the order process is abandoned after you have entered all your information, we will inform you immediately by email to ensure that the abandonment was not due to a technical error. This processing is on the basis of Art. 6 section 1 subsection 1 point f GDPR, because it is in our mutual interest to avoid unintended abandonment or an order process.

3.6 Availability notification

We offer a product availability notification service. If you opt to use this service, we need

  • your email address.

As soon as the desired product is available once more, we will notify you with one email to the address you entered.

The legal basis for this data processing is Art. 6 section 1 point b GDPR, because you have asked us to send the availability notification and this processing is necessary for us to provide the desired service.

3.7 Product guide

On our website, we offer you the opportunity to answer some questions to find a suitable product.

To do this, we process your information in conjunction with the log file (see point 3.1 below).

The legal basis for this is our legitimate interest in providing you with a tool that helps you to find the right product. We process only the necessary information on the basis of Art. 6 section 1 subsection 1 point f GDPR. Because use of this tool is voluntary and therefore in your interest, your confidentiality interests do not outweigh our interest in providing this service.

3.8 Advertising

Three months after the registration of a product or a repair, we will send you a customer satisfaction questionnaire. This takes place under Art. 6 section 1 subsection 1 point a GDPR on the basis of your consent, in order to improve our products and services. Participation in the questionnaire is voluntary. For this purpose, we use the services of Qualtrics Ireland Limited, Costello House, 1 Clarendon Row, Dublin 2, D02 TA 43, Ireland.

Furthermore, we use the data collected to the extent permitted by law for customer acquisition, especially for sending advertising by post and email. The legal basis for this data processing is Art. 6 section 1 subsection 1 point f GDPR, because the advertising of related products and services by means of direct advertising represents a legitimate interest for us as the provider of this website.

You may withdraw your consent to data processing for advertising purposes at any time (see section 7).

3.9 Newsletter

(a) Registration, creation and mailing

On our website, you can register for our newsletter, which provides information on our latest products and services. To do this, you must enter the following:

  • your email address, and

  • language and country.

We use the double opt-in process for registration. Once you have registered on our website, you will receive an email containing a link that you can use to confirm that you are the owner of the email address and would like to receive the newsletter. Only once you have confirmed will you be sent the personalized newsletter.

After you have registered, we process the personal information you have provided in this context on the basis of your consent under Art. 6 section 1 subsection 1 point a GDPR so that we can send you the newsletters.

(b) Statistical survey and analysis of the newsletter

The newsletter contains a ‘web beacon’, which is a one pixel file that is downloaded from the mailing service provider’s server when you open the newsletter. When it is downloaded, it captures technical information, such as details of your browser and system, together with your IP address and the time it was downloaded. This information is used for technical service improvements based on the technical data or target groups and their reading behavior according to download location (determined with the aid of the IP address) or access times. The statistical survey also includes identifying whether the newsletter was opened, when it was opened and which links were clicked. This information can be linked to individual newsletter recipients for technical reasons. However, neither we nor the mailing service provider seek to monitor individual users. The analysis is used more to identify the reading habits of our users and adapt our content to suit them or to send different content according to the interests of our users.

The legal basis for carrying out the statistical survey and analysis is your consent under Art. 6 section 1 subsection 1 point a GDPR.

(c) Cancellation / Withdrawal
You can cancel your subscription to our newsletter at any time, i.e. you may withdraw your consent. This simultaneously removes your consent to be sent the newsletter by the mailing service provider and to the statistical analysis. Unfortunately, it is not possible to withdraw consent to be sent the newsletter by the mailing service provider or to the statistical analysis separately. You can find a link to cancel the newsletter at the end of each issue.

3.10 Job Applications

SWAROVSKI OPTIK collects and processes personal data from applicants in order to carry out the application process.

(a) Careers page

Job applications can be submitted through our Jobs & Careers website at https://jobs.swarovskioptik.com/Jobs. This also involves a general registration of your applicant profile. In particular, the following personal information is captured:

  • (optional) Salutation, title, address (addition)

  • Gender, forename(s), surname,

  • Date of birth, nationality,

  • Address, telephone number, and email address.

  • Resume (as a document),

  • (optional) Photo, covering letter, references, other documents,

  • (optional) Information on how the applicant heard about SWAROVSKI OPTIK.

You must set a password. We then check your suitability and process your personal information on the basis of Art. 6 section 1 subsection 1 point b GDPR in order to decide on the justification for an employment relationship.

You can also choose to have your application held on file. We will then inform you of any future positions by email or telephone. We therefore process this data on the basis of art. 6 section 1 subsection 1 point a GDPR.

If SWAROVSKI OPTIK concludes an employment contract with you, the data transmitted for the purposes of establishing the employment relationship is stored subject to the statutory provisions. If no employment contract is concluded with you and you do not wish your data to be held on file, the application documents will be erased 6 months after notification of the rejection decision. If you wish your information to be held on file, it will be deleted on receipt of your withdrawal of consent, or after 2 years.

(b) Application via other routes

If your application reaches us by another route (e.g. by email, post, or submitted by hand), we will process all the personal information contained therein (e.g. the information described in section (a) above) on the basis of Art 6 section 1 subsection 1 point b GDPR in order to decide on the justification for an employment relationship. The data will be deleted 6 months after notification of any rejection decision. If SWAROVSKI OPTIK concludes an employment contract with the applicant, the data transmitted for the purposes of establishing the employment relationship is stored subject to the statutory provisions.

3.1 Social networks

Our presence on social media offers you extensive contact and information options. Under certain circumstances, these social media services independently capture personal information, e.g. through the profile you set up.

On some SWAROVSKI OPTIK websites, you will find buttons for social plugins for other online offers. These buttons do not establish contact with the provider’s server. Only by clicking on these buttons do you grant your consent for communication with the provider of the relevant platform, and a connection is activated.

If you are already registered on a social network of your choice, this takes place without opening another window. As this data is transmitted directly, we have no way of knowing its content. All that is transmitted here is the fact that you have downloaded the corresponding page. If you are simultaneously logged into Facebook etc., this information will be linked to your social media account and will therefore be linked to you personally.

For further information on the use and storage of your personal data by these various platforms, you should contact these social media companies directly.

4. COOKIES AND TOOLS IN DETAIL

SWAROVSKI OPTIK uses cookies in the provision of its services. Cookies are small text files that are stored on your device via a web browser. These are either long-term (permanent cookies) or temporary for the duration of a session (session cookies). Session cookies are automatically deleted after the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or they are automatically deleted by your web browser. 

Many websites and servers use cookies. Cookies often contain a cookie ID. A cookie ID is a unique identifier for that cookie. It consists of a sequence of numbers that can be assigned to specific websites and servers via the web browser in which the cookie was saved. This allows the websites and servers visited to tell the difference between the individual browser of the data subject and other web browsers with different cookies. A specific web browser can be recognized and identified via the unique cookie ID.

Using cookies enables SWAROVSKI OPTIK to offer users of the website more user-friendly services, which would not be possible without setting cookies.

Cookies mean that information and offers on our website can be optimized to suit the user. For example, visitors to a website that uses cookies do not have to enter their access information every time they visit the website, because that is taken care of by the website and the cookie stored on the user’s computer. Another example is the shopping cart cookie in an online shop. The online shop remembers the items that the customer has placed in their virtual shopping cart using a cookie. The legal basis for the use of such cookies is contract fulfilment (Art. 6 section 1 subsection 1 point b GDPR).

Furthermore, we work with a variety of service providers who support us to improve our website and services or who offer additional functions. These service providers may use their own cookies under certain circumstances. These generally require your consent, without which such cookies will not be used. You can read more about this in the following subsections.

Regardless of the need for consent, you can configure your browser so that you can be informed of the setting of cookies, only allow cookies in individual cases, limit the acceptance of cookies to specific cases or generally exclude and automatically delete cookies when the browser is closed.

Furthermore, cookies that have already been set can be deleted at any time via your web browser or another software program. This is possible in all current web browsers. If you deactivate the setting of cookies in the web browser, it is possible that some functions of our website will not be available.

More specific information on the details of processing by the tools described below, such as the categories of data processed, the duration of storage, the legal basis and data recipients, can be found in the relevant section under Cookie Settings / Services.

4.1 Usercentrics Consent Management Platform

We use the Usercentrics Consent Management Platform to manage cookie consent provided by website visitors. The provider is Usercentrics GmbH, Sendlinger Str. 7, 80331 Munich. The tool makes it possible to grant consent for specific functions on our website, for example linking to external elements, statistical analysis, or personalized advertising. Consent can be granted or rejected for individual or all functions. All settings made can be changed later.

Use of the Usercentrics Consent Management Platform fulfils our obligation under § 25 section 1 of the Telecommunications Telemedia Data Protection Act (Telekommunikation-Telemedien-Datenschutz-Gesetz “TTDSG”) to obtain your consent before setting cookies other than those which are necessary for technical reasons.

4.2 Google Analytics (with anonymization function)

SWAROVSKI OPTIK has integrated Google Analytics components (with anonymization function) on this website. Google Analytics is a web analytics service. Web analysis is the capture, collection, and analysis of data on the behavior of visitors to the website. Google Analytics collects data such as the website from which a data subject accessed the website (known as the referrer URL), which sub-pages of the website were accessed, or how often and for how long a sub-page was viewed. Web analysis is primarily used to optimize a website and to produce a cost-benefit analysis of web advertising. The cookie set by Google Analytics on your device allows your web browser to send relevant information to Google every time you download the SWAROVSKI OPTIK website. As part of this technical process, Google gains knowledge of personal data, such as your IP address, which Google will use for purposes such as determining the origin of visitors and clicks and subsequently making commission calculations.

The operating company of the Google Analytics component is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland.

SWAROVSKI OPTIK uses the “_gat._anonymizeIp” function of Google Analytics for web analytics. This function allows the IP address for the data subject’s web connection to be shortened and anonymized by Google before transmission to the USA if access to our website is from an EU member state or another state that is party to the European Economic Area agreement. Full IP addresses will only be transmitted to a Google server in the USA in exceptional cases, and they will be truncated there.

The purpose of the Google Analytics component is to analyze the flow of visitors to our website. Google uses the collected data and information for purposes including analyzing how our website is used, to draw up online reports for us showing activity on our website and to provide services in conjunction with the use of our website.

4.3 Hotjar

Swarovskioptik.com uses Hotjar, analysis software from Hotjar Ltd. (“Hotjar”) (Dragonara Business Centre, 5th Floor, Dragonara Road, Paceville St Julian's STJ 3141, Malta, Europe). Hotjar enables us to measure and analyze usage behavior (clicks, mouse movements, scrolling, etc.) on our website. The information about your visit to our website generated by the tracking code and the cookie is transmitted to the Hotjar server in Ireland and stored there.

4.4 Google-Ads and Google Conversion Tracking

SWAROVSKI OPTIK has integrated Google Ads into this website. Google Ad is a web marketing service that allows advertisers to run adverts in Google search engine results and also on the Google advertising network. Google Ads allows an advertiser to specify keywords in advance that will only cause an advertisement to be displayed in the Google search engine results when the user uses the search engine to retrieve a search result containing the relevant keywords. In the Google advertising network, the advertisements are distributed between websites on relevant topics using an automatic algorithm and taking into account the previously defined keywords.

The operating company of Google Ads is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland.

The purpose of Google Ads is to advertise our website by inserting advertising relevant to the user’s interests on third-party websites and in Google search engine results and by inserting third-party advertisements on our own website.

We use conversion tracking within the framework of Google Ads. If you arrive at our website by clicking on a Google advert, a conversion cookie is placed on your device by Google. This cookie is only valid for 30 days and cannot personally identify the user. Provided that the conversion cookie has not expired, it traces whether specific sub-pages of our website, such as the shopping cart, have been downloaded. The conversion cookie enables both us and Google to trace whether a data subject who accessed our website via an advertisement generated any turnover, such as by completing or aborting a sale.

The data and information collected through the use of the conversion cookie are used by Google to generate conversion statistics for our website. We find out the total number of users who have clicked on our advert and were taken to a website equipped with a conversion tracking tag. Using these statistics, we can determine the success or failure of each ad and optimize our advertisements for the future. Neither our company nor any other Google Ads advertising customer receives any information from Google which would enable the data subject to be identified.

4.5 Facebook Pixel, Facebook Customs Audience

With your consent, within our internet presence we will use the “visitor action pixel” from Facebook Inc., 4 Grand Canal Square, Grand Canal Harbour, D2 Dublin, Ireland (“Facebook”).

Using the Facebook pixel, we can keep track of users’ actions once they have seen or clicked on a Facebook advertisement. This enables us to determine the effectiveness of Facebook advertising for statistical and market research purposes. It is also possible to identify the users of our online presence as a target group (“custom audience”) for displaying advertisements ( “Facebook ads”). We therefore use the Facebook pixel to ensure that we only show the Facebook ads we have chosen to those Facebook users who have also shown an interest in our online presence or who have specific characteristics (e.g. interest in the subjects or products we specify).

When using custom audiences via the pixel process, a direct link is created between the user’s browser and the Facebook server. Context data (e.g. referring URL, browser information and the Facebook user ID) and user-defined data are transmitted to Facebook. Furthermore, we cannot rule out that additional personal information regarding the user may be sent to and processed by Facebook. This makes it possible for Facebook to link the visit to our website to the corresponding Facebook account and to identify the user accordingly. As far as we are concerned, the data captured is anonymous, so we do not see the personal data for any individual user.
